1.1 These terms and conditions relate to goods which you offer to purchase from the Bata Shoe online store ("our/this Website"). Please read these terms and conditions, which govern our use of this Website and our supply to you of any goods which offer to purchase through our online facilities. Offer to purchase is subject to the provisions of the Agreement (as defined in your clause 3.1 below) between you and us. If you do not accept these provisions you should not place an order.
These terms and conditions may be changed at any time by the Company and we are not under any obligations to notify you of such changes.
In these terms and conditions:-
2.1 "Commencement Date" means the date when agreement is concluded between us (See clause 3.3);
2.2 "Confirmation Form" means the form that is shown on screen after order is placed, confirming details of the goods agreed to supply to you;
2.3 "Consumer" means an individual who uses the goods for personal use only, and not for use in connection with any trade, business or profession;
2.4 "Order Form" means the form completed by you online and showing details of the goods which you have offered to purchase from Company;
2.5 "Goods" means the goods to be provided by Company, has been offered by you for purchase, as described in the Order Form. (In the event of discrepancy between the description of the goods on the website and that on order form and the confirmation form, the description in the confirmation form shall be conclusive);
2.6 "We/Us/Our/Company" refer to Bata Pakistan Limited, a Company incorporated in Pakistan under the provisions of the Companies ordinance, 1984 and having its registered office at Batapur, Lahore 53400, Pakistan.
2.7 "You/Yours" refer the person offering to purchase goods from Company.
3 YOUR AGREEMENT WITH US
3.2 Nothing in our website is intended or shall be interpreted to mean that the Company making a legal offer to you to purchase the goods. It is entirely at our discretion to accept or reject the offer to purchase.
3.3 The Agreement is concluded only when the Company has accepted your order by sending you a confirmation email (with the date of conclusion of the Agreement being the date shown on the confirmation email).
4.1 Payment can be made by using any of the methods listed in this Website (payment options) and will be debited when the Company has accepted the offer to purchase.
4.2 All prices are quoted in PKR (Pakistan Rupees) and include sales tax where applicable.
4.3 The acceptance of offer to purchase goods is subject to availability of goods. The confirmation of order via web or email is not a guarantee of delivery. Company will inform you if it is unable to deliver the goods which you have offered to purchase and a full refund will be given in Pakistan Rupees.
4.4 Every effort has been made to ensure the descriptions and price of goods are correct. The Company will inform you as soon as possible in the event of an error in pricing or description coming to its notice. If the Company notifies you of such an error, you will have the option of either (i) confirming your offer to purchase subject to the corrected description or price, or (ii) retracing your offer to purchase and receiving a full refund if the goods have been paid for.
5.1 All deliveries are subject to stock availability and authorization of your payment.
5.2 Free delivery of goods is provided upon purchase of Rs. 2500 (Rupees two thousand five hundred) and above. A delivery cost of Rs. 200 (Rupees two hundred) will be charged for purchase of less than Rs. 2500 (Rupees two thousand five hundred).
5.3 The Company shall endeavor to deliver the goods you have offered to purchase within 3-7 working days after we receive your offer. If there are any delays the Company will notify you of such delay as soon as possible. However, force majeure events are expected.
5.4 The Company will deliver the goods during office hours (9am – 5pm) within Pakistan at the given address from Monday to Friday excluding public holidays.
5.5 All orders must be placed before 1.00 pm local time to ensure that you receive your product within the specified delivery period. Please note that certain goods may not be delivered within the specified delivery period due to the unavailability of stocks.
5.6 The Company can either deliver your order to the shipping address as mentioned by you during order, or an alternative address such as a workplace, university or friend/family address at the checkout. The alternative delivery address must be in Pakistan.
5.7 A signature will be required upon delivery of the goods to you. Receipt of a signature at the delivery address will be verified that the order had been delivered to you. A signature may be obtained from any person at the given delivery address.
5.8 If no person is present at the delivery address you have provided, the courier may attempt delivery with a neighbour who will be asked to sign on your behalf. On neighbour refusal to receive the goods on your behalf, the goods will be returned by the courier to the Company as undelivered. (Next delivery will be on cost).
5.10 We use Leopard Courier as our delivery partner to deliver your order.
6 CLAIM POLICY
Bata products are manufactured with the utmost care and high quality control is always maintained. However, there can be chances of defective goods. In case you find a manufacturing defect in the goods purchased, kindly contact Customer Service at 0800-89999 or write us at email@example.com.
6.1 30 days warranty claim for manufacturing defect is given to customers from the date of purchase if the goods purchased is brought to Bata stores with invoice and in original packing. Claim settlement would be at the sole discretion of shop manager.
7 EXCHANGE & RETURN POLICY
We are committed to ensuring your satisfaction with any merchandise you have ordered from us. However, if you’re unhappy for any reason, here’s what to do.
7.1 You may exchange the delivered goods at the nearest Company’s outlets within 7 days of the delivery on production of original invoice provided the goods are unused, must be packed in their original packing with all tags attached, unworn/undamaged condition and not altered.
7.2 Company will only offer a replacement against any merchandise available at the store, at the time of exchange/claim being made.
7.3 If the value of the replaced article is more than original value, the store will recover the difference in cash against the sale.
7.4 In the event that the goods are not suitable, you may return the delivered goods at the nearest Company’s outlets within 7 days of the delivery provided the goods are unused, must be packed in their original packing with all tags attached, unworn/undamaged condition and not altered. The Company will return the price you paid for the goods through Gift Voucher subject to the deduction of the bank charges, if any.
7.5 For exchange/return, please contact our customer care department at 0800-89999 or write us at firstname.lastname@example.org.
7.6 Store manager may refuse to accept any exchange or return at its discretion if he does not possess required goods.
7.7 The decision of the Company would be considered final in all cases.
8 RIGHT TO CANCEL
The Company may cancel this agreement any time without any prior notice to the customer at its sole discretion.
9 PAYMENT OPTIONS
We accept payment through the following methods of payments:
· Payment will be made to Easypaisa mobile account number 03468999900.
· After receiving payment, order will be processed.
9.2 Cash on Delivery (COD)
· Payment will be received in cash and Pak Rupees at the given address. Our courier will not accept any cheque or demand drafts.
· Kindly note that no other promotional schemes like Reward Points, Gift Vouchers etc. are applicable on COD.

11 COMPLAINTS MANAGEMENT
11.1 Company operates a complaints handling procedure to resolve any disputes that may have arisen. You may need to contact us according to the contact details stated in Clause 1.1 of these Terms and Conditions.
11.2 In the event of a complaint it will help us if you can describe the object of your complaint as accurately as possible and details of your order as provided in the Confirmation email. Should you not receive any feedback from us within 7 working days, please make further enquiries. In rare cases, your email may be caught up in our spam filters or not reach us due to any technical difficulties.
12 LIMITATION OF LIABILITY
IMPORTANT: THIS CLAUSE CONTAINS PROVISIONS WHICH RESTRICT THE EXTENT TO WHICH THE COMPANY IS LIABLE TO YOU FOR ANY LOSS YOU MAY SUFFER IN CONNECTION WITH THE GOODS. PLEASE READ IT CAREFULLY AND DO NOT MAKE AN OFFER TO PURCHASE THE GOODS UNLESS YOU AGREE TO THIS CLAUSE.
IMPORTANT: THIS CLAUSE CONTAINS PROVISIONS WHICH RESTRICT THE EXTENT TO WHICH YOU ARE LIABLE TO THE COMPANY FOR ANY LOSS THE COMPANY MAY SUFFER IN CONNECTION WITH THE GOODS. PLEASE READ IT CAREFULLY AND DO NOT MAKE AN OFFER TO PURCHASE THE GOODS UNLESS YOU AGREE TO THIS CLAUSE.
You agree that you shall be liable for, and hereby agree to indemnify the Company on demand in respect of any and all demands, liabilities, losses, costs and claims (including reasonable legal fees) sustained or incurred by the Company, its agents, suppliers, resellers, its customers, officers or employees and arising as a result of breach by you of this Agreement.
14 WEBSITE CONTENT
The Company has used reasonable care and skill in compiling the content of its website but make no warranty, express or implied, as to the nature or accuracy of any material on the website and cannot accept liability for any particular material on the website or as a result of any use of or reliance placed upon information contained within the website. The Confirmation Form is conclusive as to the charges and the description of the Service. Although every effort is made to ensure complete accuracy, some prices or details shown on the website may change from time to time, and it is possible that errors will occur. The Company will use reasonable endeavors to rectify any errors as swiftly as possible.
